1. Who we are and what this covers

These Terms & Conditions ("Terms") cover Website Solutions quote requests, website builds, and the Support Locals giveaway on apexwebsitesolutions.com. Automations and AI Receptionist have separate offers and terms. By submitting a form or approving a written quote, you ("you", "the client") accept the terms that apply to that service.

2. Our services

Apex Website Solutions designs and builds websites for small businesses in Australia. Each project has a written page list, features, price, and delivery plan. You can review a free working prototype before you approve paid work.

When the agreed project is fully paid, Apex hands over the deliverables listed in your written quote. Hosting, domain, licences, and third-party tools are included only if the quote says so.

3. Pricing and quotes

Published prices are starting estimates in Australian dollars. Your exact fixed price and any tax treatment are shown in writing before you approve paid work. The price may change only if you approve a changed scope in writing. No sales call is required.

4. Website build payment terms

The prototype is free to review. You do not pay before you approve the prototype and written project scope.
After approval, 50% of the fixed project price is due by Stripe before the main build continues.
The remaining 50% is due at delivery, before final handover.
All amounts are shown in Australian dollars. The written quote confirms the final project price before paid work begins.

5. Optional care

Website care is optional. It starts only if you accept a separate written offer that lists the work, price, and terms. No monthly service is added automatically.

6. Revisions and scope

Your quoted price includes the scope described in your quote confirmation (pages, features, and integrations listed). Material changes to scope after work has started (e.g. additional pages, new integrations) may be quoted separately before we proceed.

7. Content and assets

You are responsible for providing accurate business information, and for holding the rights to any text, images, logos, or other material you supply to us. You grant us a licence to use that material solely to build and operate your website.

8. The "Support Locals" monthly giveaway

Each month, Apex randomly selects one eligible Queensland small business from free entries submitted at apexwebsitesolutions.com/support-locals.html. No purchase is required.

Eligibility: the business must operate in Queensland, Australia. The entrant must be 18 or older and authorised to enter for that business. Apex staff, contractors, and immediate family are not eligible.
Entry: one entry per business per calendar month, with accurate contact and business information. Incomplete or false entries may be disqualified.
Entry window: entries close at 11:59pm Brisbane time on the 18th. The next round opens after the draw on the 19th at 5pm Brisbane time. Entries are not accepted while a round is closed.
Selection: one eligible entry is selected at random on the 19th of each month at 5pm Brisbane time. Apex will contact the selected entrant by email. Entry text and optional publicity permission do not affect the odds.
Prize: one brochure-style website of up to 3 pages, one design direction and one revision, with a maximum service value of A$1,000. The page list and delivery plan are agreed in writing. E-commerce, paid third-party tools, domain and hosting costs are excluded unless stated in writing. The prize cannot be exchanged for cash or transferred.
Unclaimed prizes: if the selected entrant does not reply within 7 days, Apex may select another eligible entry.
One win per business: a business that has already won this giveaway cannot win again.
Case study permission: the optional checkbox allows Apex to ask to publish your business name, industry, and entry story if you win. You can enter without checking it. Apex will ask separately before using a photo or any detail you did not submit.
Data use: entry information is used to run this Website giveaway and contact you about your entry. It is not consent to marketing emails.
Apex may modify, pause, or end the giveaway with reasonable notice on this page.

9. Cancellation and refunds

Any cancellation, refund, or remedy is handled under the written project agreement and the Australian Consumer Law. Nothing in these Terms removes rights that cannot legally be excluded.

10. Liability

We take reasonable care to deliver a working, secure website, but we do not guarantee specific business outcomes (e.g. exact lead volumes or search rankings). To the maximum extent permitted by Australian law, our liability for any claim is limited to the amount you paid us for the relevant service.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

12. Governing law

These Terms are governed by the laws of Australia.
